The Legal System, Economics, and the Promotion of Public Policy

Abstract: This 5 page report discusses the incentives and disincentives that the American legal system provides in the promotion of public policy What is often forgotten in the frustration of dealing with America's legal system is the very simple fact that, convoluted though it may often seem, it still provides the framework for the protection of individual rights and freedoms. An economics viewpoint can be used to analyze public sector decision making because decisions are made within a framework of incentives and constraints that are a product of individual preferences and institutional structure. Those various incentives and constraints are, in turn, defined by the law. Bibliography lists 4 sources.
